چکیده:

This Policy Brief paper is part of a multidisciplinary research project funded by the Office of Applied Research, Iran Water Resources Management Company (IWRMC) at Newcastle University in collaboration with international partners including West Asia and North Africa (WANA) Forum, United Nation University (UNU) and World Justice Forum (WJF). The aim of the paper is apply the principles of traditional and ancient land and water resources governance system namely ‘Hima concept’ to develop governance principles for a community-based land and water resources legal framework. The term ‘natural resources’ replaces ‘land and water’ throughout the paper to reflect the explicit inter-linakge between land and water resources. Hima concept which was modified by Islamic legal theory, promote sustainable livelihood, resources Conservation, and environmental protection for the human wellbeing. Islamic principles (Sharia); Islamic legal theory (Fiqh); and Islamic development (Maqasid) Model have been used to derive Hima governance which is based on sustainable livelihood and environmental protection and conservation. It can be conclude that Islam put a coherent set of principles for an equitable and sustainable use and management of natural resources. Using Islamic principles as an entry point to develop a viable CBNR governance system is recommended..
